CN SAMR Seeks Opinions on Anti-trust Compliance Guidelines for Internet Platforms, Involving 8 Scenarios Like 'Pick 1 Out of 2'

China's State Administration for Market Regulation (SAMR) drafted the Anti-Monopoly Compliance Guidelines for Internet Platforms (Draft for Comments), and opened it for public consultation last Saturday (15th).

To help platform operators better identify anti-trust compliance risks and enhance the readability and vividness of the provisions, the Guidelines combined anti-monopoly regulatory enforcement experience, and listed eight risks for platform operators through examples, naming algorithm collusion between platforms, organizing or assisting platform operators in reaching monopoly agreements, unreasonably high pricing by platforms, selling below cost; blocking or banning, ‘pick one out of two’ practices, ‘lowest price across all platforms’ and discriminatory treatment by platforms.
